§ 31.070 ESTABLISHMENT.
(A) There is established, pursuant to M.S. § 412.501, as it may be amended from time to time, a park board, to be known as the Janesville Park Board.
(B) There is established a Park Board of Directors with specific limited powers as established, defined and outlined in this subchapter. (Res. 2008-11, passed 5-27-2008)
§ 31.071 COMPOSITION.
(A) The City Park Board of Directors shall consist of five directors who are appointed by the Mayor, subject to the approval of the City Council. Four of the directors shall be appointed from individuals who reside within the city limits, and one director shall be appointed from the City Council to serve as a liaison between the City Council and the Park Board of Directors.
(B) Park Board members shall serve a four-year term. Should a Board member resign or no longer qualify for service on the Board, the Mayor shall appoint a new member to fill the vacancy for the remainder of the uncompleted term. Members are subject to a term limit of two four-year appointments, excluding completion of vacant terms. The Board appointments shall be staggered so that no more than one Board member term expires annually. Terms of the boards and commissions of the city expire on December 31 of the final year of a particular term. The City Council may extend any term of any Board member or commissioner an additional month while appointments are made to fill impending vacancies. Rights and responsibilities of Chairpersons will be extended with their term, should it be their term that is extended an additional month.
(C) Ultimate legal responsibility for the Park Board rests with the City Council by virtue of ownership. Board members are accountable to the City Council and may be removed for any lawful reason by majority vote of the City Council. (Res. 2008-11, passed 5-27-2008)
§ 31.072 ORGANIZATION.
(A) The Park Board shall elect a Chairperson and Vice-Chairperson from among its appointed members for a term of one year.
(B) The Park Board shall hold meetings as required to carry out its duties with a minimum four meetings in any calendar year. It shall adopt rules for the transaction of business and shall keep a record of its actions and findings, which record shall be a public record. (Res. 2008-11, passed 5-27-2008)
§ 31.073 POWERS AND DUTIES.
(A) The Park Board shall elect a Chairperson and Vice-Chairperson from among its appointed members for a term of one year. The Park Board shall advise the City Council on issues concerning the development and use of public parks within the city limits and review any other issue as directed by the City Council.
(B) The Park Board shall work with city staff and the Planning Commission regarding any park dedication requirements for new subdivisions within the city.
(C) The Park Board shall fulfill any other duties as directed by ordinance or request of the City Council.
(D) The Park Board shall recommend to the City Council any maintenance, beautification and care for all park property.
(E) The Park Board may provide musical and free entertainment for the general public. (Res. 2008-11, passed 5-27-2008)
§ 31.074 POWERS OF CITY COUNCIL.
(A) Any power not expressly granted to the Park Board of Directors shall be reserved to the City Council itself. The City Council expressly reserves the right to investigate, evaluate or examine the current or proposed operations, programs or any other topics or issue as it sees fit to investigate, evaluate or examine, either through itself as a whole, its members, its employees or agents.
(B) As a general matter of policy, the Park Board of Directors should be involved in any such evaluation, examination or investigation unless it is determined in the sole discretion of the City Council, its members, employees or agents that, for whatever reason, it would be unwise, impractical or illegal to include the Park Board of Directors.
